Highlighted passages still need to be filled in before going live.
Purpose and scope
These terms and conditions of sale (the « T&Cs ») govern the contractual relationship between:
- Lisa DUCHAUFFOUR, sole trader (entrepreneur individuel, EI), whose registered office is located in Remiremont (France), registered under SIRET No. [98837212400012] (hereinafter the « Seller »);
and any natural person not acting as a trader (hereinafter the « Customer » or « Consumer ») making a purchase on the website www.taste-of-french.com (the « Site »).
Any order implies full and unreserved acceptance of these T&Cs, which the Customer acknowledges having read and understood before confirming. The applicable T&Cs are those in force on the date of the order.
Products and services
The Seller offers, in fully digital form:
- French lessons by video call (25- or 50-minute sessions), booked via the Site’s online booking tool;
- « Premium » subscription giving access, in exchange for a monthly payment, to exclusive content (quizzes, flashcards, dictations, audio articles, etc.) that is regularly expanded;
- Access to clubs and other educational content offered occasionally on the Site.
The essential characteristics of each product or service are described on the corresponding pages of the Site. The Seller reserves the right to develop the content of its offer, without this affecting orders already placed.
Prices
Prices are shown in euros (€). As the Seller applies the tax regime stated on the Site, VAT is handled as follows: [to be completed — VAT regime, see note on international digital services].
The Seller reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force at the time the order is confirmed. For the subscription, any price change is notified to the Customer in advance and applies only to billing dates after that notification.
Order and payment
The order is confirmed once these T&Cs have been accepted and payment has been confirmed. Payment is made online via the methods offered on the Site (bank card and/or other payment providers). Transactions are secured by the payment provider; the Seller does not have access to the Customer’s full bank details.
The Customer receives an order confirmation by email. Access to the service is opened once payment has actually been received.
Premium subscription
The Premium subscription is taken out for a period of one (1) month, renewed automatically at each due date for a new one-month period, by automatic debit of the amount then in force (currently €5.99 / month).
The Customer may cancel the subscription at any time, free of charge and without giving a reason, from their personal account or by contacting the Seller at contact@taste-of-french.com. Cancellation takes effect at the end of the current period already paid for: Premium access remains active until that date, and no further payment is taken thereafter. Sums already paid for the current period are not refunded (subject to Article 7).
Booking and cancellation of lessons
Lessons are booked via the Site’s online booking system, according to available slots. After booking and payment, the Customer receives confirmation and connection details.
- Rescheduling / cancellation by the Customer: any request must be sent at least 1 hour before the booked slot. After this deadline, the lesson is considered due and is neither rescheduled nor refunded.
- Customer running late: the session ends at the scheduled time; lost time is not made up.
- Cancellation by the Seller: if prevented from delivering the lesson, the Seller offers to reschedule to an agreed date or, failing that, refunds the lesson concerned.
Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Consumer is in principle entitled to a 14-day period to withdraw from a distance purchase, without having to give a reason.
Exceptions applicable to Taste of French:
- Digital content supplied immediately (Premium subscription, exercises, instantly accessible content): in accordance with Article L.221-28 13° of the French Consumer Code, the Customer expressly waives their right of withdrawal and acknowledges losing this right once performance (access to the content) has begun after their express consent, before the end of the 14-day period.
- Services fully performed before the end of the 14-day period, with the Customer’s express consent and acknowledgement of the loss of the right of withdrawal (Article L.221-28 1°), do not give rise to withdrawal.
When confirming the order, the Customer ticks a box by which they request immediate access / performance and acknowledge waiving their right of withdrawal under the conditions above.
For orders not falling within these exceptions, the Customer may exercise their right of withdrawal by notifying their decision to contact@taste-of-french.com; the refund is made within 14 days of receiving the request.
Supply and access
Access to content and services is provided online, either immediately or at the booked slot depending on the product. The Customer is responsible for having a compatible internet connection and equipment. A temporary technical unavailability beyond the Seller’s control cannot engage the Seller’s liability.
Legal guarantees
Independently of these T&Cs, the consumer Customer benefits from the legal guarantee of conformity applicable to digital content and services (Articles L.224-25-1 et seq. of the French Consumer Code) as well as, where applicable, the guarantee against hidden defects. On this basis, the Customer may obtain the bringing into conformity of non-conforming digital content or service under the conditions provided by law.
Intellectual property
The purchase of a product or the subscription gives the Customer a personal, non-transferable right of access to the content, strictly for private learning purposes. Any reproduction, distribution, account sharing, resale or commercial exploitation of the content is strictly prohibited. All content remains the exclusive property of the Seller.
Liability
The Seller has an obligation of means as to the educational quality of its lessons and content. It cannot guarantee a specific result (passing an exam, reaching a given level), as this also depends on the Customer’s own involvement.
Personal data
Personal data collected is processed in accordance with the Privacy Policy and the GDPR.
Governing law, mediation and disputes
These T&Cs are governed by French law. However, a Consumer residing in another European Union State retains the benefit of the mandatory more protective provisions of the law of their country of habitual residence.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, the consumer Customer may use, free of charge, a consumer mediator with a view to the amicable resolution of a dispute:
- Mediator: [name of consumer mediator to be designated]
- Site / contact details: [mediator contact details]
The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr
Failing amicable resolution, the competent courts will be determined in accordance with the applicable rules of law.
